Privacy policy regarding personal data

Within the Alioli Loyalty Program, the locations of the Alioli Group operate through:

SC LA BRASA SRL, headquartered in Bucharest, Sector 5, Str. Sold. Ene Modoran, No. 5B, with tax identification number RO33208319, registered with the Trade Register under no. J40/6263/2014.

The associated operators process the personal data provided by you within the Alioli Loyalty Program exclusively for the purpose of carrying out advertising, marketing, and promotional activities in accordance with the principles established by the applicable data protection legislation in Romania, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC („GDPR”).

The data will be disclosed to TOKYO STYLE S.R.L., the company that developed and maintains the online platform, as well as to collaborators who manage the Loyalty Program.

Given that the data is necessary for carrying out the specific activities conducted by the entities mentioned above for your benefit, by completing the form received within the Alioli Loyalty Program and providing your personal data, you express your consent to their use under the above conditions.

If you do not agree with the use of your personal data under the above conditions, we inform you that participation in the Alioli Loyalty Program is not possible, and we ask you not to complete the participation form for the Alioli Loyalty Program. 

In accordance with the General Data Protection Regulation, you have the right to access, intervene on your data, and the right not to be subject to an individual decision. You have the right to object to the processing of your personal data and to request its deletion.

 

PRIVACY POLICY

Respecting the right to the protection of personal data, as well as the right to privacy, is one of the fundamental missions of the Alioli Group.

TOKYO STYLE S.R.L., headquartered in Bucharest, Sector 1, Str. Radu Boiangiu No. 8, Bl. 38, Sc. B, Ap. 54, registered under no. J40/6190/2015, with CUI 34546660, is authorized to process your personal data on behalf of, for the account of, and in accordance with the instructions of the associated operators.

This group is managed by the associated operators mentioned above.

Thus, we undertake all necessary steps to process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC („GDPR”).  Personal data means any information relating to an identified or identifiable natural person („data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.

 

WHAT KIND OF PERSONAL DATA DO WE PROCESS?

If you are a customer or potential customer:

We collect personal data as a result of most interactions with you, as well as in the context of other aspects of our activities. The categories of personal data we collect are:

  1. Name, surname, email address, phone number, date of birth, gender;
  2. Information you provide regarding your marketing preferences or during participation in contests, raffles, or certain promotional offers;
  3. Transactions and their components, bill values, locations where bills were issued, the number of visits to Alioli Group locations;
  4. Vouchers generated, vouchers used, and the value of the transaction to which they were applied;
  5. Reservation data made either by phone or through the mobile app, the number of people, date and time, chosen location;
  6. Any other types of information you choose to provide us.

However, if you choose not to provide certain personal data, where the basis for our request is the fulfillment of a contractual obligation or an obligation necessary for the conclusion of a contract, we will be unable to provide you with certain services. For example, if you do not provide your name, surname, email address, or phone number, you will not be able to become a member of the Alioli Loyalty Program.

 

PERSONAL DATA OF MINORS

Only individuals who have reached the age of 18 can enroll in the loyalty program.

 

SENSITIVE DATA

The term „sensitive data” refers to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, and the processing of genetic data, biometric data, health data, or data concerning a person’s sex life or sexual orientation.

In general, we do not collect sensitive information unless you choose to provide it to us. We may use health data provided by you to better serve you and meet your special needs (e.g., preparing food without including ingredients to which you are allergic, providing access for persons with disabilities).

 

FOR WHAT PURPOSE AND ON WHAT BASIS DO WE PROCESS YOUR PERSONAL DATA? 

If you are a customer:

a) Running the Loyalty Program: We process your personal data to offer various benefits within the Alioli Group restaurants (e.g., saving information about your bills to credit your account with points representing 10% of the bill value).

Basis: Contract performance.

b) Reservations at Alioli Group locations:

Purpose: We process your personal data to reserve a place at your preferred locations.

Basis: Conclusion of a contract.

c) Pickup or delivery orders:

Purpose: We process your personal data to fulfill your orders, whether you choose pickup or delivery.

Basis: Performance of the restaurant service contract.

d) Monitoring and analyzing interactions with the loyalty program to provide a personalized experience at Alioli locations**:

Purpose: To provide personalized services, transactions, frequency, and locations visited are analyzed to offer bonuses or personalized offers based on your interactions.

Basis: Consent.

e) Feedback:

Purpose: We process your personal data to ensure you had a good experience with us.

Basis: Our legitimate interest in constantly improving the services we offer and providing services that meet our customers’ standards.

f) Marketing:

Purpose: We process your personal data for marketing purposes, such as commercial newsletters and marketing communications about new products, services, or other offers we believe may be of interest to you.

Basis: We rely on our legitimate interest to promote our services by transmitting offers we consider of interest to you (see „Right to Object” in the „Your Rights” section).

If necessary, in accordance with applicable legislation, we will obtain your consent before processing your personal data for direct marketing purposes. In this case, we will inform you that you can withdraw your consent for marketing processing at any time, in which case you will no longer receive any marketing communications from us. We will include an unsubscribe link that you can use if you no longer wish to receive messages from us.

g) Other communications: By email, mail, phone, or SMS.

Purpose: These communications will be made for a specific reason, such as: (i) responding to your requests, (ii) if you did not complete an online reservation, we may send you an email to remind you to complete the reservation, (iii) to inform you about how complaints and/or incidents that occurred during your time at our restaurant were resolved.

Legal basis: Our legitimate interest in providing services at the highest standards by resolving any requests/complaints and ensuring our full availability.

h) Analysis, improvement, and research:

Purpose: To ensure the constant evolution of the quality of our services, we carefully analyze each complaint/suggestion from you. Thus, we use your phone data (number, system version, access history) to resolve certain technical issues that may arise so that you can use the Alioli app at any time.

Basis: We rely on our legitimate interest in providing services that meet your standards and those of the Alioli Group.

 

TO WHOM DO WE DISCLOSE YOUR PERSONAL DATA?

To provide you with the expected level of hospitality and high-quality services, we may disclose your personal information to members of the Alioli Group, our service providers, and other third parties, as detailed below:

  1. Suppliers: To provide the requested services, in some cases, we will need to disclose some of your personal data to suppliers, who are authorized to process the data on our behalf, for our account, and in accordance with our instructions (e.g., software, IT, marketing agencies, accounting services).
  2. Members of the Alioli Group as authorized persons: For similar purposes or related to those for which they were collected.
  3. Events: If you participate in certain events at the restaurant, and the event is organized in collaboration with third parties, the personal data you provide for participation in the event may be shared with the other organizers and, if applicable, with other event participants.
  4. Business partners: In some cases, we partner with other companies to provide you with products, services, or offers we consider relevant for members of the Alioli Loyalty Program.
  5. Co-sponsors of promotions: In some cases, we co-sponsor promotions, lotteries, raffles, competitions, or contests with other companies, or we may provide prizes for lotteries and contests sponsored by other companies. If you participate in these lotteries or contests, we may disclose your personal data to the co-sponsor or a third-party sponsor.
  6. Authorities and/or public institutions: For (i) compliance with legal provisions, (ii) responding to their requests, (iii) reasons of public interest (e.g., national security).

Your data confidentiality is important to us, which is why, where possible, the disclosure of personal data in accordance with the above is made only under a confidentiality commitment from the recipients, ensuring that the data is kept secure and that the provision of this information is done in accordance with applicable legislation and policies. In any case, we will only disclose to recipients the information strictly necessary for achieving the respective purpose.

 

DO WE COLLECT PERSONAL DATA FROM THIRD PARTIES? 

To provide you with the expected level of hospitality and the best level of services, we may collect information about you from members of the Alioli Group, our business partners, and other third parties, as detailed below:

  1. Members of the Alioli Group: For similar purposes or related to those for which they were collected.
  2. Our business partners: For well-defined purposes.
  3. Co-sponsors of promotions: In some cases, we co-sponsor promotions, lotteries, raffles, competitions, or contests with other companies, or we may provide prizes for lotteries and contests sponsored by other companies. If you participate in these lotteries or contests, we may collect your personal data from the co-sponsor or a third-party sponsor for the purpose of organizing them and awarding prizes to the winners. In any case, we assure you that your data collected from third parties will be processed under the same conditions as if it had been collected directly from you. Additionally, we will only collect what is necessary to fulfill our purposes (see the section „FOR WHAT PURPOSE AND ON WHAT BASIS DO WE PROCESS YOUR PERSONAL DATA?”).

Furthermore, when we contact you for the first time, we will inform you of the source from which we obtained your personal data.

DO WE TRANSFER YOUR PERSONAL DATA OUTSIDE THE EU/EEA?

No, your data will not be transferred to countries outside the European Union or the European Economic Area.

PROVIDING PERSONAL DATA OF OTHER INDIVIDUALS BY YOU 

If you provide us with personal data of other individuals for the purpose of resolving a complaint or sending a gift voucher through the Alioli app, please inform them in advance of this disclosure and the manner in which their data will be processed, as described in this Privacy Policy.

HOW LONG DO WE KEEP YOUR PERSONAL DATA?

Your personal data necessary (name, surname, email address, and phone number) for running the loyalty program will be retained for the entire period of your activity as a member of the program. The rest of the processed data will be deleted after a period of more than 2 years from the respective action. We constantly review the need to retain your personal data, and if the processing is no longer necessary and there is no legal obligation to retain the data, we will destroy your personal data as soon as possible in a manner that ensures it cannot be recovered or reconstructed. If personal information is printed on paper, it will be destroyed in a secure manner that ensures it cannot be reconstructed, and if it is stored on electronic media, it will be deleted using technical means to ensure that the information cannot be recovered or reconstructed later.

 

WHAT ARE YOUR RIGHTS?

As a data subject, you have the following rights under the GDPR:

  1. Right of access: You can request (i) confirmation as to whether or not personal data is being processed and, if so, access to the data and information about it, as well as (ii) a copy of the personal data we hold (Art. 15 GDPR);
  2. Right to rectification: You can inform us of any changes to your personal data or request that we correct the personal data we hold about you (Art. 16 GDPR);
  3. Right to erasure („right to be forgotten”): In certain situations (e.g., (i) if the data was collected illegally, (ii) the data retention period has expired, (iii) you have exercised your right to object, or (iv) the data processing is based on consent and you have withdrawn your consent), you can request that we delete the personal data we hold about you (Art. 17 GDPR);
  4. Right to restriction of processing: In certain situations (e.g., if you contest the accuracy of the data or the legality of the processing), you can request that we restrict the processing of your data for a certain period (Art. 18 GDPR);
  5. Right to data portability: You can request that we send your personal data to a third party or directly to you (Art. 20 GDPR);
  6. Right to object: In certain situations (e.g., processing based on legitimate interest), you can request that we no longer process your data (Art. 21 GDPR).If we use your personal data based on your consent, you have the right to withdraw this consent at any time. In this case, your data will no longer be processed by us, unless a legal provision obliges us to retain and archive it. In any case, we will inform you if such a legal provision exists and will expressly indicate it.To learn how to exercise any of the above rights, please refer to the „Questions or Complaints” section.

 

IS YOUR DATA SAFE?

We take your personal security very seriously, which is why we implement important security measures necessary to protect against unauthorized access to data or unauthorized alteration, disclosure, or destruction of data. This includes internal reviews of data collection, storage, and processing practices and security measures, as well as physical security measures to protect against unauthorized access to systems where we store personal data.  We also require our service providers and business partners to take all necessary measures to protect against unauthorized access to data or unauthorized alteration, disclosure, or destruction of data.

 

QUESTIONS OR COMPLAINTS

If you have questions or concerns regarding the processing of your personal data or if you wish to exercise any of the rights mentioned above, you are welcome to contact us in writing at the following email address: loyalty@alioli.ro . To facilitate the resolution of your request, it is important that the request is sent from the email address with which you are registered in the Alioli Loyalty Program. After submitting the request, a representative of the Alioli Group will contact you and request additional information to identify you and facilitate the exercise of your right. It is important to respond to the Alioli representative’s request and provide all necessary information to identify you; otherwise, for security reasons, we will be forced to reject your request.  You can also exercise any of the rights mentioned above by submitting a request (i) by mail or, on business days between 10:00-18:00, directly at our headquarters in Bucharest, Str. Caderea Bastiliei, No. 78, Sector 1, or by phone at +40752.966.966. Regardless of the chosen method mentioned above to exercise your rights, we will respond within a maximum of 30 days from receiving the request.

If you are not satisfied with how your request was resolved, you can file a complaint with the National Supervisory Authority for Personal Data Processing.
